Victualling Stores at Aberdeen.

I have the honour to acknowledge receipt of your letter No.C.105 dated 5th July, 1940.

2. As the buildings are not to be of cheap temporary con- struction, transfers of the areas to the Commissioners for executing the office of Lord High Admiral would seem to be more appropriate than permits.

3. The areas would be held subject to the terms of Ordinance No.1 of 1863, particularly sections 3 and 8, and the following conditions (mostly on the precedent of the Infectious Diseases Hospital on Inland Lot No.87) are suggested:-

(a) A cash premium at the rate of 30 cents per square foot to be paid by the Admiralty to the Colonial Treasury in respect of each area. This premium (or a pro rata part) to be repaid by the Colonial Treasury to the Admiralty without interest on surrender, when the areas or either of them are no longer required for naval purposes.

A nominal annual rent of $1.00 in respect of each area to be paid by the Admiralty to the Colonial Treasury, by equal half yearly payments on 24th June and 25th December in each year.

The areas to be used only for naval purposes, not to be alienated by the Commissioners and when no longer required for naval purposes to be surrendered without payment of compensation for buildings by the Colonial Government.

In the case of each area a twenty feet strip adjoining Island Road to be retained as a Crown Reserve and the portions of the approach roads over these reserves to be treated as rights of way.

On your informing me that these terms are acceptable I shall have surveys of the areas made and shall pass the plans to the Land Officer for preparation of Memoranda of Transfer.
